My buddy got a speeding ticket where the cop wrote down his name wrong. I was under the immpression that if the cop messed anything up on the ticket it was throw out. Is this true? The cop put his last name where it says first name and his first name where it says family name. I told him to take it to court cause they should throw it out but is it that simple?

take it to court tho, might be able to lower it
but errors on the ticket usually dont do much

that won't do anything. But I'd take it to court anyways, just to try and fight the ticket.

It may or may not do anything... usually its the errors you can't point out that are the kind of mistakes that get it thrown out. When I got pulled over in my duster a few years ago for loud exhaust, I looked it up and down to see if the ticket was wrong, or any mistakes where made so I could try and get it reduced at very least. Couldn't find any error... But I had to go fight it anyways, since I was unemployed at the time, all I could afford was gas. Anyways I went in and spoke with the justice of the peace, and she said there was a error on the ticket, and it has to be dropped. I was like... Oh, what part was wrong... She wouldn't tell me but it was $110 ticket dropped 100% of the charge.. I wasn't goin to argue. Sometimes it's worth it to try and fight it anyways.. You never know.

Date, names, streets, all info that can be overlooked. (seems pretty unfair)

The only time a Ticket can be quashed is incorrect amount. Dwn DAK, it must be the price.

I had a 360.00 speeding ticket that was reduced to 0. (quashed), because the officer made a mistake, and amount should have been 392.00 They had just increased the set fines, and the officer must have gapped out.

incorrect set fine, officers name wrong, location of offence wrong are all fatal errors on the ticket and will be tossed

they can pretty much f up the rest of it and it will still stand in court

and the JP may also allow the above mentioned mistakes to be ammended at the trial

My father was charged with running a red light. Officer wrote the incorrect intersection, but the ticket remained.

and i also stated the mistake may be ammended at trial at the judges discresion

9 times out of 10, if the identity of the person who received the ticket can be verified, any errors will be ammended in court, and it will not be thrown out.

Any tiny error like the given name and family name mixed up doesn't mean anything. They won't even bother amending that. They'll simply proceed as planned.

You can fight it if you want, but I wouldn't get your hopes up. You're going to get stuck paying it.

i've never heard about a incorrect name either way, sorry

I was in court once and a lady was on trial for failing to stop at a stop sign. The lady was like 60ish and when the cop was giving her testimony she forgot to mention that the offence had occoured in the province of Ontario everything else was mentioned in detail. The Judge (God bless his soul for squashing my ticket) scolded the cop for not mentioning the province and 0'ed the ticket.
