Didn't you say you were hurt? That's enough of a reason right there for the insurance to have to pay up. Show the court your medical report. Either way, congrats on the find!

Yeah I got a concusion and some cuts, but apparently that's not enough to sue in Michigan

Lol, thanks again man. I do know the guys name though, is there a way to find out what they do to him (like if he gets jail time?)

If so it would be awesome to find out where they're keeping him at and send up some care packages full of gay porn, edible undies and some KY or some @!#$ like that.

If he doesn't go to jail we can look at fitting him for some concrete boots

Well here is the scope according to this long 5 Page list of stuff. What I am about to quote is Michigan No-fault Insurance Law...

Problem 1: You got hit and run, you are out of luck, unless the individual feels obligated to pay for your damages of his own free will, the police will do nothing in this matter, and can do nothing if this matter. It is your word against his.

Problem 2: You have witnesses, GOOD! BUT...none can agree on anything, therefor you are out of luck here yet again, remember, you would have to prove that he was indeed the one driving the vehicle, in a court of law!

Problem 3: You had no collision coverage! With No-Fault insurance law, each person takes care of their own damages, He takes care of his, you take care of yours, their is nothing in the no-fault law that says he has to take care of your damages, not since Oct of 1973 when No-Fault law started!!!!

Problem 4: You could maybe get him on a Mini-Tort, AKA(tort Law), better known as Limited Property Damage Liability, but this here is a long shot. It works by paying your collision deductible back to you if you have collision that is, and you are not the one at fault. Or it can be used if you don't have collision, and you were say rear-ended, to go back on him for up to $500.00 of your damages, but thats it. A police report would be worth its weight in gold, if you have one, that is...I don't know if you do or not.

Problem 5: Your injuries, You pay for them!!!, thats why you have Auto Insurance, just in case you get hurt, your auto ins. helps you and his helps his. Your outta luck here too!

Problem 6: A Lawyer wont help...NOPE!! They know no-fault law up, down, back, forth, sideways, and many other dimensions! The reason they wont help you, is this. They wont help because they hit a brick wall on this before, they cant get him to pay, no-fault law restricts the number of lawsuits from happening, not that they don't stop happening that is! Do not pursue that issue further, it will most likely end up costing you $$ in the end!

Problem 7: This is a case of hit and run, with various unprofessional witness's at best! You cant prove anything under a court of law, you will be told that you needed collision coverage, you will be given no help by the police...they have better things to do...assuming they would even show up at the trail!, if there was one! I'm sorry I am being so blunt here...but the law is the law!

This is getting long isn't it!!!!

This info from me is for Michigan Only, not other states in the union! It is common info that your own insurance agent can and should be able to tell you. If he cant...for heavens sake find one that can!!!! He is being paid commissions by YOU!!!!!!!!!!!! to be of service when you need it the Most!

I hope this info has helped you some, I know the info was not good, but I don't sugar coat things for people, I tell them the truth!!!

Thanks man, yeah that was all pretty much as I thought.

I do have a police report and the guy confessed to being the driver. So like I was saying all I can do is go after him for the $500.

Do you know if I get to go after him personally or his insurance for the $500? It may not seem like theres a diff. but

If I get to go after him personally than I def. will just so I can see the guy in court, for many reasons.

If I hafta go after his insurance company I will probably be less inclined, as the $500 isn't that big of a deal. Getting to look this guy in the face so he knows that I'm the reason he has a fellony on his record would be worth it.

Sorry, I still thinking on this, 0303 Eco--- unfortunely, you are at a real empass here. Theres really not much that can be done, if your insurance agent cant make any progress with it. As I stated above, you have exhausted all of the avenues that the State of MI has to work with, and this is where the no fault law really starts to show is weakness's!

Theres really no way under No-Fault that you could really get all your damages fixxed, and theres no going to the others persons insurance, except MAYBE that $500.00 rule, (I'm going out on a limb there, saying you have that coverage), if you dont...GET IT NOW!!!! is only $1.82 per 6 months!!!!, Your agent should have gave it to you, to begin with.

Just seen your post, You will have to have your insurance go after his insurance...a process sometimes until you get your $500.00.

Please do this, because that persons insurance company will log the payout of the claim, and will maybe give him a accident convict code on his policy, thereby raising his rates...a small consolation...yes..but something

As far as a court appearance, I don't know, the way the court system is..Maybe..you might see a criminal record come of it, but it will most likely take a while....

PS: I would go after the $500.00 and pursue it...thats what you paid all that money out for insurance for...something!

Yeah I had that coverage. I'm really just pissed off at myself for taking full coverage off of it when I got it paid off. That was my fault, and a mistake I will never make again. If nothing else I hope that if anyone living in a No Fault state reads this that they won't make the same mistake.

I'm sure my ins. agent will do whatever they can for me, I told them about the accidnt the day it happened, but I didn't have a report until a few days ago. So I will have to get back in touch with them now (I should have yesteerday, but I was just too damn busy at work). I will update again after I talk to my agent, but I'm pretty sure all the stuff stated above will be exactly how it plays out. My insurance should re-imburse me for all of my out of pocket medical expenses.

About the mini-tort though. Do I get to sue him personally? Or his ins company?

So first we needs some cement see, and then a box see, that what we's do's is we get the guy and we's ties him up like nice and tight so he can't move like ya know? Then we's puts his foots in da box and we's dumps in da cement see. Then we wait and we all laugh at him and tells him how hes gonna be sleepin with da fishes, maybe slap him round a lil bit ya know jus ta have some fun wit em. After a couple hours of makin fun of em den we's puts him da trunk of like a Lincoln and we's drives him out to da docks and maybe mess wit him some more, let him beg some cause its fun to hear them cry. Then when we's gets tired we's trows him into da lake.

dude michigan sucks. wtf is the point of having insurance if its not going to do anything?

in cali, if you get in an accident and its labeled as the other persons fault (ESPECIALLY if the other person ADMITS to it), you get everything fixed by their insurance. if they don't have insurance, they're put in jail until a court date and then you sue them.

i'm glad i don't live in michigan. i'd be pissed if i paid 2100 bucks a year for them to tell me i'm screwed.

Michigan has the No-Fault law enacted in Oct of 1973...before most people on the JBO here where even born! It has been with us a long time now. If you do not know how it works, I would not downplay it!

This accident is a perfect textbook case of what not having full coverage (COLLISION COVERAGE) will do to you, here in the state of MI. it happens everyday, I see more times than ever, nowadays...

The one thing that MI no-fault does that other states cannot touch is this...

Lets say the above individual was hurt seriously in the accident (IE: He was paralysed and in a wheelchair for the rest of his life! The state of MI. would pay all his medical expenses for his LIFETIME...YES LIFETIME!!until he dies! Your insurance cant say that!

It would also give him a income for at least 3 years, can your ins. say that. It would give him a vehicle he could get around in, refurbish his house for his needs, etc. All this and more, PLUS...he could still go after the other guy for his lost wages and pain and suffering, can your insurance say that!

Most insurance companies let you pick your level of Liability and Medical coverages, MI does not..You get unlimited medical coverage!!..One reason why MI insurance is so expensive.

Do you have 10 years expertise in insurance...I do! I have a license from the state of MI to prove it!

After reading all of this, I don't understand what the point of liability insurance is in Michigan. Does it cover anything other than being able to go after someone for 500 dollars?

No, don't excuse you.

No-fault still does blow.

Basically you don't get @!#$ out of an accident until you are crippled. Maybe this is just me, but I would still rather have California law. I would rather have a law where if somebody messes up, then they pay for it no matter what than me getting a free handout because I can't feel my legs.

Well the guy can't be too happy now that he was caught. Hit and Run is a felony in michigan regardless of situation. And the this situation also falls into one of the worse categories. I'm pretty sure I put a link to the Michigan hit and run laws in a post up there somewhere.
