How about the Forum Moderator give people the benefit of the doubt and quit acting like the teacher from Pink Floyd: The Wall? There are legal uses for the software, and it's ultimately the responsibility of the person at the computer to decide what to use it for.

Everyone of the listed programs are 100% legal. Yes, they are distributed, sold and freely exchanged. The content that individuals decide to share and search out may, or may not be.

How's about letting the individual decide what to do? Machzel didn't say "Hey, here's a great place to get tons of illegal copyrighted software and songs!" He gave his opinion on the software, and its access to content. There wasn't anything explicitly stating that he was talking about illegal downloads, so let's not assume the worst?

I understand JBO's site liability, but this is getting a tad rediculous. People know right from wrong, how about not insulting people and letting them read and respond?

Does Kazaa Lite still work because I can't access the net when I use it. I think I read somewhere that Kazaa shut down but I don't remember.

Yes, Kazaa lite does work. But why use a Fast Track client when there are many better ways of transferring files?

I think there's bigger issues with illegal racing activities posted in the Versus forum, but
the RIAA is likely more active in searching out forums/sources of information regarding
intellectual property downloading, regardless of whether people claim its for legal use only.

I can't blame Dave for wanting to keep this stuff off of his website. The last thing he needs
is for this forum to get known as a source of information for "Limewire, kazaa, winmx, ares,
bearshare, etc"

By locking the topic, it's acknowledged to be against the rules.

I seriously don't know of any better ways. I use bit torrent sites now, but I find it's easier to use kazaa if I want to get smaller files.

As I recall, GAM, the issue regarding implied uses of such software has been discusses with you before in AG. When the topic is clearly about downloading MUSIC using those programs, it leaves little doubt in my mind the legality of the use of such programs. Sometimes I feel that you simply argue for the sake of arguing. Regardless of what you CAN do with the software, the discussion in those threads had a specific point - downloading music, which is illegal.

Like you say though, those programs can be used to download other such material. Therefore, I moved this to the war forum so we can discuss both sides of using said software.

Yeah, right....everyone that downloads Ares, Limewire and Kazaa is using it to download unregistered shareware and public domain music.

Bull@!#$.

EVERYONE knows that 99.9999999% of the use of those networks is to download free copies of stuff that SHOULD be paid for. If you don't believe that, or would like us to believe otherwise, then you're living in a fantasy world.

Lets face it - the people who download w/out buying where never really going to buy anyways. I'd like to see an honest statistic on how many people bought a CD because they heard it first(mostly through downloading) - you won't find that from the RIAA

See here's the thing about this site's "what you can post" guide lines - Inconsistencies.

So do you wanna guess how many people are learning from here how to "throw on NAWS"(lol), then using it to break more laws than I want to know about. Do you think that it isn't a fact that - a large percentage ARE using this(or any modification) to break the law?

You CAN legally use a 230HP 2.4 DOHC(for example). You CAN legally use Kazaa or whatever. Spare me the percentages.

You think you're less liable for someone learning how to go faster from here than learning how to download files from here?!

You've been reading too many "warez sites" and ".nfo file" disclaimers. "Evaluation purposes" is a farce, and is completely illegal. Once again, JBO won't be a party to it.

You can quote whatever statistic you want about how many CDs you have bought or your friends have bought or whatever, but it doesn't change the fact that downloading music is copyright infringement, is illegal, and discussing it in these forums is a violation of the Terms of Service.

The NHTSA doesn't shut down websites for discussing upgrades to cars. The RIAA DOES actively pursue shutting down websites encouraging the illegal downloading of music. There is no comparison between the two. If it's such an upstanding and legal activity, and so easy to prove how legal it is, then why did Napster shut down? Why did WinMX's founders shut off their servers without even appearing one day in court? The answer is BECAUSE THEY CANNOT WIN. The law is clear, and now the precedents are clear.

Similar to the above...the State of California doesn't go after websites for discussing upgrades to cars. The RIAA and similar organizations have entire departments dedicated to initiating action against file sharing websites AND against sites where their programs are promoted or even discussed.

We don't allow discussion of how to remove the governor on J vehicles. Sure it has a potential legal use on cars that are trapping high in the 1/4 mile, but the risks to the site in allowing that discussion far outweigh the benefits.

To end this debate, JBO WILL NOT EVER condone the discussion of illegal file sharing. If that infringes on the "rights" of the <.0001% of people that use the services for legal reasons then sorry. It's not worth the risk to our network. File sharing is illegal. "Evaluation purposes" is illegal. Making music AVAILABLE FOR DOWNLOAD is illegal. The case precedents are clear and the risks involved by allowing it are clear. There are forums all over the internet dedicated to the discussion of file sharing, downloading music and software, etc. You can feel free to discuss these activities there, as they are not (and never will be) allowed on JBO.
