What isn't fair, is that this boy was unfairly excluded from a sport that he wished to participate in. Semantics aside, the court ruling had no effect on the school's decision wether he could participate or not. It was just affirming that the organization and school couldn't be sued for their decision.
The lack of detailed information regarding the justification of or reasoning behind his exlusion prohibits me from commenting on this further, unless it were hearsay.

As such, that would make it so that the fall sports in the previous example would be cross country, volleyball, and football. If you're good enough, you make the team, if not, you ride the pine.
